In the course of conducting procedure of bankruptcy Alexander Borisovich Furman carried out a number of auctions on sale of property of the bankrupt, thus, according to Chuyko Irina, not all of them were lawful.

"So, at sale of such assets of the debtor as a share in authorized capital LLC "Alfa", the competitive managing director intentionally suppressed the fact of sale of subsidiary, and were veiled by a subject of auctions in the form of debit debts" — the lawyer noted.

When Shchukin Alexander appealed to court, Alexander Borisovich Furman declared that everything who wanted to buy shares LLC "Alfa", participated in auctions, and allegedly Schukin had to know that this asset of the bankrupt is on sale. Besides, Alexander Borisovich Furman referred to that fact that existing rules allegedly did not provide inventory of shares in authorized capitals of the affiliated organizations belonging to the bankrupt.

"During bankruptcy procedure cannot be sold just like that something secretly, to the acquaintance: there have to be open auctions, it has to be accurately clear that is on sale — Chuyko Irina explained. — Everything who wants, can participate in them. And what has happened? When the valuable asset — a share in LLC "Alfa" was on sale — the competitive managing director wrote that rights of the requirement to LLC "Alfa" are on sale. Thus, competitive managing directors (and the same Alexander Borisovich Furman) at other auctions do not experience difficulties and perfectly write directly that shares and actions are on sale. Respectively, nobody participated in auctions, except Timur Frank through the company — LLC "Adonis" who perfectly understood that he buys".

on December 7 in Arbitration court of Novosibirsk region there took place debate on which stated the positions representatives Shchukina Irina, Franck Timur and Alexander Borisovich Furman. The judge of arbitration vessels Nichegoryaeva Olga, having listened to debate of the parties, took a break till December 14.
