The legal commission — against a child pornography in written texts

the Legal commission suggested to reject the bill allowing the image of a child pornography in written texts on the first reading. For the offer voted 6 and against – 3 members of the commission, the press service told to Riygikogu .

Riygikogu's Initiated 13 members the bill is urged to change article 178 of the Penitentiary code which concerns production and granting possibility of production of a child pornography. According to the bill, creation of a picture or other visual work representing a child pornography, or granting possibility of its creation will not be punishable if work bears in itself considerable art, scientific, historical or political value.

according to the member Riygikogu Oudekki Loone, fictional characters, i.e. imaginations of the writer that cannot be a crime appear in written texts. " If the text describes a real situation, it can become the proof of real acts during criminal proceedings" — Oudekki Loone told.

" the so-called case Kaura Kendera was the Cause for initiation of the bill. Judicial proceedings on this case still go. Therefore the bill was initiated too hasty, without waiting for a court assessment — the chairman of the legal commission Karilayd Yaanus told. — Any text containing a child pornography, it is impossible to call art".

the Ministry of Justice does not support the offer initiated by deputies of parliament according to which the image of a child pornography would not be punishable if it bears art, scientific, historical or political value.

the Bill on modification of article 178 of the Penitentiary code (418 SE) Riygikogu Oudekki Loone's members, Gryazin Igor , initiated Barbie Pilvre , Eerik-Niyles Cross-country , Talvik Arthur, Valdo Randpere, Remo Holsmer, Khallemaa Khelmut , Marika Tuus-Laul, Vitsut Toomas, Heydi Snowstorm , Mikko Marianna and Hardy Volmer. The bill will be discussed at Riygikogu's plenary session on June 16.
