the Prosecutor's office of the Zolsky area checked compliance of existing normative legal acts in local governments of municipalities of the Zolsky municipal region of KBR to the federal legislation, the press service of prosecutor's office of KBR reports. For improvement of quality of providing municipal services by executive bodies municipal formation of the Zolsky municipal area regulations as which administrative regulations on providing municipal services are approved are adopted. By check it is established that regulations contain the provisions contradicting standards of the existing federal legislation on the organization of providing the state and municipal services, and comprise korruptsiogenny factors. So, in defiance of the Federal law of 27.07.2010 No. 210-FZ "About the organization of providing the state and municipal services" in administrative regulations are not specified:
- obligatory general requirements to a subject of the pre-judicial appeal the applicant of decisions and actions (inaction) of the body providing municipal service;
- obligatory general requirements to an order of submission of complaints through the multipurpose centers;
- obligatory general requirements to contents of complaints, in particular, are absent data on number of contact phone, the e-mail address (in the presence) on which the answer has to be sent to the applicant;
- a direction order the official allocated with powers on consideration of complaints, available materials, in bodies of prosecutor's office in establishment cases in a course or by results of consideration of complaints of signs of structure of an administrative offense or a crime;
- did not determine the made decision on results of consideration of the complaint.
the Specified violations of requirements of the federal law are the korruptsiogenny factors setting for a pravoprimenitel unreasonably wide limits of a discretion or possibility of unreasonable application of exceptions of the general rules. By results of check the area prosecutor's office on the specified regulations of 9 municipalities of the Zolsky municipal region of KBR brought 25 protests which are now at a consideration stage.
