Constitutional Court of the Russian Federation will specify conditions of the conclusion of contracts after auctions with one participant

As the judge-speaker on the this case Gadis Gadzhiev told, in 2019 JOINT-STOCK COMPANY "SISTEMNY OPERATOR YEDINOY ENERGETICHESKOY SISTEMY" (JOINT-STOCK COMPANY "SISTEMNY OPERATOR YEDINOY ENERGETICHESKOY SISTEMY") announced competition on performance of work on cleaning of the adjacent territory according to Law "About Purchases of Goods, Works, Services by Separate Types of Legal Entities". Only one demand was allowed to participation, and organizers decided to recognize auctions cancelled - according to article 447 Federal law of the Russian Federation of 30 November 1994 No. 51-FZ "On the Civil Code of the Russian Federation". However Department of the Federal Antimonopoly Service on Moscow region considered that time the proposal of the participant meets initial conditions competitions, contract has to be concluded.
