Constitutional Court of the Russian Federation explained the bases for detention bodies of police of citizens when carrying out single pickets

In the Resolution Constitutional Court of the Russian Federation of 17.03.2017 No. 8-P "On the case of check of constitutionality of provision of point 13 of part 1 of article 13 Federal law of the Russian Federation of 7 February 2011 No. 3-FZ "On Police" in connection with the complaint of the citizen Valery Ivanovich Sergienko" are explained the bases for detention by bodies of police of citizens when carrying out single pickets.
So, the provision of point 13 of part 1 of article 13 Federal law of the Russian Federation of 7 February 2011 No. 3-FZ "On Police" about bringing of the citizen in office of territorial body or police division, to premises of municipal body, in other office for its protection against direct threat of his life and to health in case he is not capable to take care of itself(himself) or if danger cannot be avoided otherwise, regarding its distribution on the citizen carrying out single picketing, is recognized not contradicting Constitution of the Russian Federation as on the constitutional legal to sense it means that when carrying out single picket, for the citizen there is a threat of life and to health. Thus the Constitutional court specified that threat of such picket in a venue is real, instead of estimated, being expressed in high risk of infliction of harm of life and to health of the citizen who is carrying out picket, as a result of its own actions, actions of other persons or manifestation of natural, technogenic and other factors. it is Also specified that legislatively concrete term of such bringing of the citizen in the relevant office of police is not established, in connection with impossibility to provide and consider the concrete circumstances influencing its duration (territorial remoteness, existence and (or) technical condition of transport, capacity of highways, climatic conditions, a state of health delivered, etc.) . At the same time, the specified measure has to be carried out as soon as possible. Besides, by the specified resolution it is explained that after drawing up the protocol on bringing in office of police of the citizen if the bases for application to it this measure disappeared, it is subject to immediate release, in the absence of other lawful bases.
