Magomedov appealed in appellate court against definition of the first instance of September 16. Then Magomedov's actions regarding not reflections in reports of the managing director of data on expenses on carrying out competitive production were recognized illegal. Besides, are recognized illegal inaction of the managing director, expressed in not reduction of workers of the debtor during bankruptcy procedure.

At the same time the arbitration rejected requirements of the applicant about collecting from Magomedov 330,3 million rubles of losses.

Earlier the court prolonged till December 22 competitive production concerning the debtor.

the Arbitration united on September 22, 2015 in one production the statement of the competitive managing director of "Dagestan Airlines" with the claim of his creditors about involvement of the former heads of airline to subsidiary responsibility according to obligations of the debtor. The court united in one production the claim of the managing director Baymurzaev Magomedrasul to the former general director of airline Mirza Omariyevu with the claim of creditors to other ex-general director Abakarov Zhabir, to Omariyev and five board members.

Company "MEGA" in the statement specified that asks to bring solidary respondents to subsidiary responsibility according to obligations of "Dagestan Airlines" "at a rate of the remained outstanding debt to creditors proceeding from a difference between the size of requirements of the creditors included in the register of requirements of creditors, and the money obtained from sale of property of joint stock company".

Arbitration on September 11, 2013 according to the Mixjet Fliqht Support company statement (United Arab Emirates) declared airline bankrupt.
