On June 18, 2015 Appeal definition of Judicial board on administrative affairs of Regional court of Stavropol in the matter of N33A-488/2015 according to the statement of the prosecutor of the city Pyatigorsk in interests of an uncertain circle of people about regulatory legal act contest in part is taken out.

The judicial board defined:

of March 11, 2015 to cancel the decision of Pyatigorsk city court of Stavropol Krai.

In satisfaction of requirements of the prosecutor of Pyatigorsk to recognize invalid from the date of acceptance the State Duma "About the approval of the Master plan of municipality of the resort town Pyatigorsk" regarding the adoption of the regulatory legal act without introduction of data on existence in the territory of municipality of the resort town Pyatigorsk the following especially protected natural territories of regional value: the nature sanctuary of regional value "Mount Beshtau" and nature sanctuary of regional value "Mountain Dubrovka" to refuse.

To recognize invalid from the date of acceptance the State Duma "About the approval of the Master plan of municipality of the resort town Pyatigorsk" (with the subsequent changes) regarding inclusion of the following territories designated on the Card (scheme) of borders of functional zones with display of parameters of planned development by red color and carried according to symbols to a public and business zone, intended for the subsequent placement of objects of commercial appointment:

- the land plots on a southeast slope of the mountain "Mashuk", around an arrangement of Federal public institution SIZO-2 Ufsin Russia on Stavropol to edge, Pyatigorsk, being in cadastral quarter: 26:33:210101;

- the land plots on east slope of the mountain Mashuk along the route M-29 "Caucasus", around km of 368-400 highways "Caucasus", in cadastral quarter: 26:33:200101;

- the land plots along the road from an outcome on Inozemtsevo's settlement before "Lermontovsky travel" on both sides of the road, in cadastral quarters: 26:33:140101 and 26:33:180101;

- the land plots along the railroad down the street the Moscow Pyatigorsk in cadastral quarters: 26:33:130109 and 26:33:130101;

- the land plots according to the prospectus of Kalinin from Georgiyevskaya St. on departure towards Nalchik from the city Pyatigorsk on the right side of the road, in cadastral quarter: 26:33:320101; in the public and business zone intended for the subsequent placement of objects of commercial appointment.

To recognize invalid from the date of acceptance the State Duma "About the approval of the Master plan of municipality of the resort town Pyatigorsk" (with the subsequent changes) regarding inclusion of the following territories designated on the Card (scheme) of borders of functional zones with display of parameters of planned development by a large stroke of brightly lilac color and carried according to symbols to a zone of recreational appointment, intended for the subsequent placement of objects of rest and tourism: the land plots on a mountain slope Mashuk to the East from the street of Kalinin and to the southeast from 295 Strelkovoy Divizii Street of Pyatigorsk, to the West from the Glade of songs, on the right side of the road to Lermontovsky travel, in cadastral quarter: 26:33:180101;

- the land plots on a mountain slope Mashuk to the East from the street of Kalinin and to the southeast from 295 Strelkovoy Divizii Street of Pyatigorsk, to the West from the Glade of songs, on the left side of the road to Lermontovsky travel, in cadastral quarter: 26:33:180101; in the zone of recreational appointment intended for the subsequent placement of objects of rest and tourism.

To recognize invalid from the date of acceptance the State Duma "About the approval of the Master plan of municipality of the resort town Pyatigorsk" (with the subsequent changes) regarding inclusion of the land plots on the southern slope of Mount Beshtau along Beshtaugorskoye Highway, the being in cadastral 26:33:050201 borders of functional zones designated on the Card (scheme) with display of parameters of planned development by red color and carried according to symbols to the public and business zone intended for the subsequent placement of objects of commercial appointment, in the public and business zone intended for the subsequent placement of objects of commercial appointment.
