YAKUTIA.INFO. the Authorities of Yakutsk are afraid that the garbage market in the city will be seized by large federal players. In this regard they hurried to create the garbage operator, reported at a press conference on Monday April 25. Before OFAS counted as violation creation of the uniform garbage operator in Yakutsk represented by JSC Yakutskekoseti .
"We had a meeting on this subject, at present we have legal proceedings with OFAS, - the first deputy head of Yakutsk Dmitry Sadovnikov . In dispute the truth has to be born. If it becomes clear that we are not right, we will cancel the decision. But in general we consider that we work for an advancing".
"Selection was made before coming into effect of the federal law, - the director general of Zhilkeomservice Municipal Unitary Enterprise Andrey Lebedev . - We selected our territorial operator in the person "Yakutskekoseti", but no incentive actions with the relation of business owners existed. The only thing, we from the city hall wrote to the address of some operators of the letter — if you want, can sign the contract with the territorial operator".
According to Lebedev, for today only three contracts are signed with "Yakutskgeoseti". Meetings with all city carriers of garbage are held. The non-profit organization of carriers which will supervise legitimacy of actions of the regional operator was created.
"Not the secret that since January 1, 2017 the regional operator in Yakutsk unambiguously will appear. Thus who it will be concrete - "Yakutskgeoseti" or any federal player — while it is not known, but it will be. Therefore we try to create the operator. Because we are afraid of history repetition in other cities when on their territory large monsters come and, without talking neither to administration, nor to business, seize the market. Consider that since January 1, 2017 payment for garbage will be made not on a quadrature, as now, and by number of the registered people".
Earlier the Head of OFAS Yury Ignatyev warned the head Yakutsk Aysena Nikolaev and about inadmissibility of creation of the garbage monopolist.
In this regard to the head of the Yakut OFAS demanded that the city hall terminated the agreement on assignment of the status of the uniform operator according to the handling of garbage in the city territory. According to antimonopoly authority, the uniform operator can negatively influence the competition in the garbage market of Yakutsk. As actually defines the primary provision of a certain subject – the uniform operator.
Since January 1, 2016 the federal law No. 404-FZ came of 29.10.2015 into force. This law makes changes in a row the acts concerning environment protection and utilization of solid household waste.
Under this law till January 1, 2017 authorities in regions have to choose the regional operator according to the address from solid household waste. It is a question of the legal entity who for ten years receives the status of the regional operator. And only it has the right for collecting, transportation, processing, utilization, neutralization, garbage burial.
The authorities of Yakutsk, advancing events, decided to create the own uniform operator on TBO export. In Yakutsk it recognized the JSC Yakutskekoseti company as which founder the municipal company "Zhilkomservice" acts.
