On February 15, 2016 in antimonopoly authority the statement of Association of carriers of household waste of Yakutsk arrived. In it it is reported that in defiance of existing rules in the city the uniform regional operator is determined by the address with household waste – JSC Yakutskekoseti.
On November 19, 2015 the city administration approved an order of selection of the uniform operator according to the address with solid municipal waste in the territory of Yakutsk. The uniform operator is a legal person who is obliged to sign the public contract for rendering cleaning service of garbage with owners of garbage. Actually this operator is imposed to citizens.
Meanwhile, as Ignatyev notes, there are no norms, "providing concept and the status of the uniform operator at the level of municipality" (about it it is told in the federal law of 24.06.1998 N 89-FZ "About production wastes and consumption").
"The accepted Order which has defined the status of uniform the operator on the address with solid municipal waste in the territory of the city district "city of Yakutsk" and its powers, has direct influence on a condition of the competition in the commodity market on collecting, accumulation, transportation of municipal waste in the territory of GO "city of Yakutsk" as actually defines the primary provision of a certain subject – the uniform operator who only will have the right to carry out activities for collecting, accumulation, transportation, processing, to utilization, neutralization and placement of waste to territories of GO "city of Yakutsk" within 10 years", - is spoken in the prevention to the mayor.
In this regard to the head of the Yakut OFAS demanded that the city hall terminated the agreement on assignment of the status of the uniform operator according to the handling of garbage in the city territory.
Since January 1, 2016 the federal law No. 404-FZ came of 29.10.2015 into force. This law makes changes in a row the acts concerning environment protection and utilization of solid household waste.
Under this law till January 1, 2017 authorities in regions have to choose the regional operator according to the address from solid household waste. It is a question of the legal entity who for ten years receives the status of the regional operator. And only it has the right for collecting, transportation, processing, utilization, neutralization, garbage burial.
The authorities of Yakutsk, advancing events, decided to create the own uniform operator on TBO export. In Yakutsk it recognized the JSC Yakutskekoseti company as which founder the municipal company "Zhilkomservice" acts.
