19.01.2016 in Office of the Federal Antimonopoly Service in the Bryansk region the application of JSC Fokinsky Combine of Construction Materials for actions of PAO "IDGC of Centre" represented by IDGC of Centre branch of JSC - "Bryanskenergo" arrived.
Representatives of PAO "IDGC of Centre" during check drew up statements of non-accounting consumption of electric energy (power) where by the network organization it is reflected that the consumer (JSC FKSM) allowed connection of transformers of own needs to the electric power metering device.
In defiance of existing rules the network organization for own needs of substation (i.e. technological losses) carried the volume of the consumed electric power on non-accounting electricity consumption, having pointed to lack of devices of accounts on transformers of own needs about what statements of non-accounting electricity consumption were drawn up. The specified acts were signed from the consumer, but at more detailed studying subsequently it was offered to network organization to withdraw them in view of lack of non-accounting electricity consumption. In the answer to the requirement of JSC FKSM to withdraw acts of non-accounting electricity consumption the network organization refused.
As the fact of non-accounting electricity consumption is not proved by the network organization Bryansk OFAS of Russia in actions of PAO "IDGC of Centre" represented by Bryanskenergo branch established violation p.1. Art. 10 of Federal Law "About Protection of the Competition" according to which actions (inaction) of the managing subject occupying a dominant position which are result or can be prevention, restriction, elimination of the competition and (or) infringement of interests of other persons (managing subjects) in the sphere of business activity or an uncertain circle of consumers are forbidden.
05.04.2016г. The decision and the instruction on elimination of violations is issued to Bryansk OFAS of Russia of PAO "IDGC of Centre".
